These Terms of Use govern your use of the INDIAreads™ service and website. The Service is provided by INDIAreads and is offered to you (hereinafter referred to as "Subscriber") as per your agreement with and acceptance of this document (hereinafter referred to as "Membership"). By clicking the box entitled "I have read and accept the Terms and Conditions of Use" as part of the registration process, you accept all items in the Terms of Use and agree to abide by and be legally bound by the Terms of Use. If you do not agree to these Terms and Conditions of Use, you should not use the INDIAreads™ service or website.
These Terms of Use are an ongoing contract between you and iRead Books Pvt Ltd™ and apply to your use of the INDIAreads service and website. These Terms of Use affect your rights and you should read them carefully.

iRead Books Pvt Ltd™ reserves the right, with or without notice, to change these Terms of Use in its sole and absolute discretion. The most current version of these Terms of Use supersedes all previous versions and can be viewed by clicking on the "Terms of Use" link at the bottom of the pages of the INDIAreads™ website.

Any personal information submitted on the INDIAreads™ website is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices. Our privacy policy can be viewed by clicking on the "Privacy policy" link at the bottom of the pages of INDIAreads™ website.

INDIAreads™ is an online subscription based book rental service that allows its subscribers to rent books through its website located at www.indiareads.com It also runs an online bookstore wherein users can purchase original titles.
To use INDIAreads™ a subscriber will have to register with www.indiareads.com to create an account. The subscriber can then browse/search books that he/she would like to read, and add them to his/her Bookshelf. Once payment has been received or we have made an arrangement with the subscriber to pick up the payment at the time of delivery, the first set of books will be delivered to the subscriber at the shipping address provided at the time of registration. INDIAreads™ rents out two (2) books at a time. Once the subscriber is done with the first set of books, he/she can visit www.indiareads.com and navigate to the "My Bookshelf" tab and ask for a Pick up of Books. The Subscriber may or may not schedule a simultaneous delivery of the next set of books. INDIAreads™ will pick up the previous set of books from the subscriber’s shipping address, and depending on the subscriber’s choice, deliver the next set of books.
Subscribers who have chosen the self –return option (not available to NCR/Delhi subscribers) have the responsibility of returning the books to INDIAreads™ when they finish reading. The next lot of books will be delivered to them according to their indicated date, but only on receipt of the previous set of books. Subscribers, registered users and other visitors to the site can also buy books by searching/browsing for them and pressing the Buy button on the single book page. The books are sent to them on receipt of payment. They are dispatched within one working day if the subscriber arranges to pay on delivery.

This Site may be accessed from countries other than India. The library and bookstore services are currently available, only in India. Users from other countries other than India are free to register and write reviews and use other features of this site. If you access and use this Site outside India you are responsible for complying with your local laws and regulations.

Upon becoming an INDIAreads™ subscriber, subscribers become responsible for paying periodic subscription fees according to the then current billing terms and subscription plan. Subscription fees are non-refundable.

Subscriptions are automatically renewed, and the subscriber will be billed the subscription fee at the beginning of the new subscription period.

By using the INDIAreads™ service, you are expressly agreeing that we are permitted to bill you subscription fee, any applicable taxes and any other charges you may incur in connection with your use of the INDIAreads™ service. Additional charges may include books you fail to return, books you damage or a billing plan change you request. As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method. The subscription fee will be billed at the beginning of your subscription and on each subscription renewal thereafter unless you cancel your membership. We will automatically bill your Payment Method on the calendar day corresponding to the commencement of your membership. In the event that your membership began on a day not contained in a given month, we will bill your Payment Method on the last day of such month. For example, if you became a paying member on January 31st, your Payment Method would next be billed on February 28th. All fees and charges are non-refundable and there are no refunds or credits for partially used periods. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by email.
In case the bills are not paid as on the due date, your account will be suspended and you will not receive any further books, till such time the payment is made. In case of your account suspension, you will have to return the books with you within seven (7) days. If you do not clear your dues within 45 days your deposit will be forfeited and membership cancelled.

A subscriber may change plans at any time. Upgrades in plans will only result in billing the difference of the plans and will be effective from the same billing cycle. Downgrades in plans will affect the next billing cycle. No refunds for partial months of use will be credited. Future billing cycles will be billed at the new rate.

Subscribers may keep their rented books as long as they wish, provided the subscriber's account is in good standing and the subscription fee has been paid. If subscription fee is not paid, INDIAreads™ will ask you to return the books within seven (7) days failing which the cost of the book will be deducted from your deposit.

Your subscription may be cancelled at any time by calling or emailing INDIAreads™ customer service. You can also go to the Cancel My Membership tab in Change library plans menu in My Account. The cancellation will take effect immediately if you do not have any books in your possession. Otherwise, the cancellation will become effective once all INDIAreads™ books in your possession are returned. We do not provide refunds or credits for any partial-month subscription periods. If you fail to return the books within seven (7) days of cancellation, you will be charged the market value for each book.
INDIAreads™ reserves the right to cancel your subscription without prior notice and without assigning any reasons.

Upon cancellation of membership, we will refund your security deposit after ensuring all outstanding charges applicable have been processed. We will issue a bank cheque in the name of the subscriber, within fifteen working days. The cheque will be mailed to the shipping address as provided by you in your account information.

INDIAReads™ handles shipping using our own delivery agents, or in partnership with a logistics provider. Within NCR/Delhi we will fulfill a delivery request within 2 business days of receiving a delivery request from the subscriber. Our goal is to ship the books with highest priority in your Bookshelf. In case a book is not available in our inventory, we will ship the book with next highest priority in your Bookshelf. Please note that our guarantee is on the book title, not book copy. That is, if you request for a particular book, we will send you the copy that is currently in stock. This may or may not correspond with the publisher, book image or publishing date that you have selected. If you wish to only be delivered the book copy that you have selected, please send an email to our customer service. This will however, lower the probability of you getting the books which are listed first on your priority list. INDIAreads™ rents out two (2) books at a time. At the time of delivery of books, our delivery agent or logistics provider will collect the previous set of books. The Subscriber must return both the previously rented books before receiving the next set of books.
In case a package is returned due to (a) non-availability of the user at the shipping address (b) user failing to return outstanding books while taking a delivery, no delivery shall be made and the cycle will be counted as a delivery.

All books sent to a subscriber are verified to be in a good condition prior to dispatch and condition of each book is recorded in our system. Upon receipt of the books, you must ensure that the books are in good condition. Any damage, if found, must be reported to our representative and conveyed to INDIAreads™ customer service via email or phone. Upon receipt of the books, we will verify the condition of the book against the condition recorded in our system before dispatch.
If a book is returned to INDIAreads™ damaged as a result of subscriber misuse, INDIAreads™ will charge you the market value of each damaged book against the security deposit. If INDIAreads™ determines that a book was damaged during transit, INDIAreads™ will not charge subscriber for the damaged book.

INDIAreads™ has a No Questions Asked Return Policy for purchased books. You can return any unopened book(s) in its original packaging, for a refund (excluding shipping and transaction costs), within 7 days of receipt of the shipment. If you cancel an order before a book has been procured and shipped, you will only be charged the transaction amount.
In case of books that are delivered to you in a damaged/defective state, we will replace the defective/damaged book picked up from you at no extra cost. However, for this, you need to inform us immediately and no later than 7 days.

Shipping of Sold books

The prices for Sale of Books Indicated on the website are inclusive of sales tax and all other applicable taxes, but not of shipping charges.
If your total order is to the tune of Rs 200 or more, shipping is free (apart for special locations). If your location is not indicated in the INDIAreads™ city menu then it may be a special location. Shipping Charges for Special locations differ with place. Contact Customer Service to schedule a delivery to such locations.
INDIAreads™ does not sell or ship books to locations outside India. For book orders where the amount payable is less than Rs 200, a shipping charge of Rs 30 will be added.
Please note that Cash on Delivery is not available for Book Purchase.
The delivery time for books varies with availability and city of delivery. Normally, books that are available are delivered within 3 working days in Delhi/NCR and within 4 working days in metros. Delivery of books will only be made upon realisation of payment.
Please note that if you purchase a book which is indicated as being out of stock, you will be charged the transaction costs.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, INDIAreads™ shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. INDIAreads™ shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and the payment made. If the payment has already been made for the purchase and your order is cancelled, INDIAreads™ shall immediately reverse the payment.

Your INDIAreads™ membership will continue in effect unless you cancel your membership or we terminate it. We will bill the membership fee plus any applicable tax to the Payment Method you select during registration (or specify later) You must cancel your membership before the renewal date in order to avoid billing of the next month's membership fees.

Special offers, if any, are available only for first-time INDIAreads™ subscribers, unless otherwise expressly stated in the offer.

The INDIAreads™ service and Website and its contents are provided "as is" and we make no representations or warranties of any kind with respect to the INDIAreads™ website, its contents or our service. We assume no liability or responsibility for any errors or omissions in the content of the INDIAreads™ website, any failures, delays, or interruptions in the shipment of books, delivery of any content contained on the INDIAreads™ Website, any losses or damages arising from the use of the content provided on the INDIAreads™ website, or any conduct by users of the INDIAreads™ service or website. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current.
In no event shall INDIAreads™, its proprietors, shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use of the INDIAreads™ Website, its contents or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
